1. Acceptance of Terms
By accessing spacezaerospace.com, purchasing our products, or enrolling in our services (including Drone Pilot Training), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "Pilot," or "Customer") and Space-Z Aerospace ("Company," "we," or "us"). If you do not agree to these Terms, you must not access or use our services.
2. Regulatory Compliance & Safe Usage
Space-Z Aerospace manufactures high-performance UAVs governed by strict national and international aviation laws. By using our products, you explicitly agree to:
- Adhere to DGCA Regulations: Operate strictly within the guidelines set by the Directorate General of Civil Aviation (DGCA) India, or the relevant Civil Aviation Authority (CAA) in your jurisdiction.
- Digital Sky Compliance: Ensure your drone is registered on the Digital Sky platform and obtain necessary UIN/UAOP clearances before flight, where applicable.
- No-Fly Zones: Strictly observe all designated Red Zones (No-Fly Zones), including areas near airports, defense establishments, international borders, and vital government installations.
- Visual Line of Sight (VLOS): Maintain Visual Line of Sight at all times during operation, unless specifically authorized for BVLOS (Beyond Visual Line of Sight) operations by the competent authority.
- Prohibited Use: Never use our technology for illegal surveillance, harassment, unauthorized weaponization, or any activity that compromises national security or public privacy.
3. User Accounts & Security
To access certain features (e.g., Fleet Management Dashboard, Store), you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. Space-Z Aerospace cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4. Intellectual Property Rights
The Service and its original content, features, and functionality (including but not limited to drone architectural designs, proprietary flight controller software, AI algorithms, text, graphics, and logos) are and will remain the exclusive property of Space-Z Aerospace and its licensors.
You are strictly prohibited from:
- Reverse engineering, decompiling, or disassembling any software or firmware embedded in our products.
- Creating derivative works based on our designs or technology.
- Using our trademarks or branding without express written permission.
5. Product Warranty & Disclaimer
Hardware Warranty: Space-Z Aerospace provides a limited warranty for its hardware products against defects in materials and workmanship under normal use for a period defined in the specific product documentation (typically 12 months for enterprise drones).
Disclaimer: Except as expressly provided, our Services and Products are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. We do not warrant that the functions contained in the product will meet your requirements or that the operation will be uninterrupted or error-free.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Space-Z Aerospace, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service or Products.
Critical Safety Note: The Pilot in Command is solely responsible for the safe conducting of each flight. Space-Z Aerospace is not liable for accidents resulting from pilot error, neglect of maintenance, or disregard for weather conditions.
7. Indemnification
You agree to defend, indemnify, and hold harmless Space-Z Aerospace and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Force Majeure
Space-Z Aerospace shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in New Delhi, in accordance with the Arbitration and Conciliation Act, 1996.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will maintain reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
